Terms of Service
Last updated: October 28, 2026
These terms are an agreement between you and Tandem Websites LLC ("Tandem", "we", "us") for using Tandem: the app at brand.builtintandem.com, Tandem's apps and connections for other tools, and builtintandem.com.
If your organization has a signed agreement with Tandem, that agreement takes precedence over these terms where they differ.
1. Using Tandem
Tandem is a service for businesses. If you use it for an organization, you're agreeing to these terms on its behalf and confirm that you're authorized to do so. You must be at least 16, or older if your local law requires it.
2. Accounts
Keep your sign-in details and any connection tokens private, and tell us if you think someone else has used them. Your organization's administrators decide who has access and what each person can do, and they're responsible for the people they invite.
3. Your content
What you and your organization put into Tandem stays yours: brand guides, rules, files, documents and anything else. You give us permission to host, copy, process and display it only as needed to provide Tandem to you, including sending it to the service providers and connected tools described in our Privacy Policy.
You're responsible for having the rights to what you upload, including licenses for fonts, images and logos.
We may use aggregated information about how Tandem is used, which doesn't identify you or your organization, to run and improve the service.
4. Tandem's property
Tandem, including its software, design and documentation, belongs to Tandem Websites LLC and its licensors. While your organization has access, you may use Tandem for your organization's business, subject to these terms. If you send us ideas or feedback, we may use them without any obligation to you.
5. AI features and brand checks
Tandem uses AI to answer questions, write drafts and check content against your brand's rules. AI output can be wrong or incomplete. Review it before you publish or rely on it.
A brand check compares content with the rules and approved claims your organization has put into Tandem. It isn't legal, regulatory or compliance advice, and a passing result doesn't guarantee that content meets any law or regulation. You remain responsible for what you publish.
6. Acceptable use
Don't use Tandem to:
- break the law or anyone else's rights;
- upload malware, or try to get into accounts, data or systems you're not allowed to access;
- overload, disrupt or reverse engineer the service, or get around its limits;
- resell or share access outside your organization, except as your plan allows; or
- build a competing product from Tandem's content or output.
7. Connected services
Tandem works with tools made by other companies. Their own terms govern your use of them. We aren't responsible for those services, and we may change or end a connection when they change their tools or terms.
8. Plans, fees and limits
Fees, plan limits (including monthly AI usage), billing, renewal and cancellation are set out in your order or plan. If a brand reaches a plan limit, some features pause until the next period or until the plan changes.
9. Changes to Tandem
We improve Tandem continually and may add, change or remove features. Free trials, and features marked as previews or betas, are provided as is and may change or end at any time.
10. Confidentiality and security
We treat your organization's content as confidential and use reasonable safeguards to protect it, as described in our Privacy Policy. Please keep anything non-public that we share with you about Tandem confidential too.
11. Ending the agreement
You can stop using Tandem at any time. We may suspend or end access if these terms are seriously broken, if payment is overdue, if required by law, or to protect Tandem, our customers or others from harm. Where we can, we'll give notice first. After an agreement ends, your organization has 30 days to export its content. We then delete it as described in our Privacy Policy.
12. Disclaimers
Except as stated in a signed agreement, Tandem is provided "as is" and "as available", without warranties of any kind, including merchantability, fitness for a particular purpose, non-infringement, accuracy of output, and uninterrupted or error-free operation. Keep your own copies of content that matters to you.
13. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Each party's total liability under these terms is limited to the greater of the fees paid to Tandem under these terms in the 12 months before the claim, or $100. These limits don't apply to your payment obligations or to your obligations under section 14.
14. Indemnity
If someone else makes a claim against Tandem arising from your content or from your use of Tandem in breach of these terms, you'll defend Tandem at your expense and cover the resulting costs, damages and reasonable legal fees. We'll tell you about the claim promptly, let you control the defense, and help where we reasonably can. You won't settle a claim in a way that requires Tandem to admit fault or pay anything without our consent.
15. Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute is heard in the state or federal courts located in Delaware, and both parties agree to those courts' jurisdiction.
16. Changes to these terms
If we change these terms, we'll update the date at the top. If a change is significant, we'll let account administrators know before it takes effect. Using Tandem after a change takes effect means you accept the updated terms.
17. General
These terms, together with any order or signed agreement, are the whole agreement about Tandem. If part of them can't be enforced, the rest still applies, and not enforcing a part right away doesn't waive it. You may not transfer these terms without our consent; we may transfer them as part of a merger, sale or reorganization. Neither party is responsible for delays or failures caused by events beyond its reasonable control, such as outages at hosting providers, natural disasters or government action, except for payment obligations.
